HornBlasters Satisfaction Guarantee / Return Policy

Hornblasters ("HornBlasters.com", "HornBlasters Inc.") is dedicated to ensuring you ("Customer") are 100% happy with your purchase. Most products are shipped with a refund/replacement guarantee period unless otherwise noted in the product listing. All merchandise unless otherwise indicated may be returned within 30 days from the shipment arrival date for a refund.

Products purchased through installers or third-party vendors are subject to the return policies and TERMS of the respective seller. Please contact them directly for return information.

A Returned Merchandise Authorization (RMA) number is required for all returns. All returns are subject up to a 15% Restocking Fee. Customers are required to pay return shipping charges. Shipping charges are non-refundable. No refunds will be made after 30 days. All packages refused by the recipient without express written authorization from HornBlasters are subject to a 15% restocking fee.

Additional deductions may be made to reflect the products current market value. These terms apply to all refunds. Customers must inform HornBlasters of any order discrepancy within 7 days from the invoice date so that we may investigate and resolve the situation accordingly.

RETURN SHIPPING OPTIONS:
If you prefer not to pay for a return shipping label locally, HornBlasters can provide a shipping label at our discounted rate. Then we can deduct the cost of the shipping from your refund. This option offers convenience and potentially lower shipping costs compared to arranging the return shipping independently.

SUBMIT A RETURN REQUEST ONLINE:

Click the profile icon in the store's navigation to request a return.

1. Log in to your account:
    a.) In the Email field, enter your email address, and then click Continue.
    b.) In your email account, open the email sent from our store and copy the six-digit verification code included in the email.
    c.) Go back to the online store, and then enter a six-digit verification code.
2. Click the order that you want to submit the return for.
3. If your order has more than one item, then select the items that you want to return.
4. Select a return reason and add a note for the store.
5. Click Request return.

If your return request is approved and requires shipping, then you receive an email with shipping instructions and a return shipping label. After the product is returned, you receive a refund.

SHIPPING POLICIES

All orders over $300 being shipped UPS, will require a signature for delivery!

Free Shipping:

To qualify for free shipping, you must place an order totaling over $100 to an address in the Continental US. Some oversize or freight-only products will not qualify, as stated on their specific product pages.

Shipping Delivery Times:

Due to changes to the service guarantee by UPS, we are unable to guarantee any delivery dates regardless of the expedited method chosen. Delivery estimates are only estimates at this time. If an expedited method does not hit the targeted delivery time, it will not be eligible for refund. When UPS is able to reinstate their service guarantees, we will be able to reinstate it as well. Quick Shipping:

We care about you getting your products right away. We know you’ve got shows to attend, distracted drivers to wake up, and plans for your purchase. For that reason, we strive to ship most orders placed Monday-Friday by 3pm EST the same day. That’s just one of the differences you’ll experience when you buy from HornBlasters.

Shipping Days:

HornBlasters ships Monday through Friday (business days) except when a carrier is not shipping due to a holiday.

Cross-Shipments:

HornBlasters will not cross-ship returned merchandise.

Physical Damage Policy:

Physical damage to any product purchased at HornBlasters.com without an extended coverage warranty will effectively void standard warranty coverage. Physical damage includes but is not limited to improper handling and/or any other type of damage sustained by irregular usage.

Processing Time:

You can expect your order to be processed within approximately 24-48 hours, provided the items are in stock and there are no problems with payment verification. HornBlasters does not guarantee same day shipping. Orders are not processed on weekends and holidays.

Expedited Shipping Orders:

Orders placed using expedited shipping after 3pm EST are subject to ship the next business day.

Purchase Agreement:

By accepting delivery of any product delivered from HornBlasters, you agree to be bound by the terms and conditions listed below. You and HornBlasters.com agree that the following terms and conditions are the exclusive terms governing the sales transaction between Customer and HornBlasters.com. Any attempt to alter, supplement, modify or amend these terms and

conditions by the Customer will be considered a material alteration of this agreement and, therefore, are null and void. In addition, these terms and conditions are subject to change at any time, without prior written notice. Please check these terms and conditions carefully each time you place an order with or accept delivery of any goods from HornBlasters

Shipping Charges:

Your total cost for purchase of any product will include shipping and handling charges shown on the HornBlasters.com invoice.

Risk of Loss:

HornBlasters will arrange for shipment of ordered product(s) to the Customer, Free On Board (F.O.B.) shipping point, meaning title to the product(s) -- excepting software-- and risk of loss passes to the Customer upon delivery to the carrier. HornBlasters reserves a purchase money security interest in the product(s) until its receipt of the full amount due. Customer agrees to allow HornBlasters to sign appropriate documents on Customer’s behalf to permit HornBlasters to protect its purchase money security interest. HornBlasters will advise Customer of estimated shipping dates, but HornBlasters will, under no circumstances, be responsible for delays in delivery, and associated damages, due to events beyond its reasonable control, including without limitation, acts of God or public enemy, acts of federal, state or local government, fire, floods, civil disobedience, strikes, lockouts, and freight embargoes.

DISCOUNTS

Discount Codes:

If you have a discount code you must enter the code at checkout. There can only be ONE discount per cart. Please make sure the code has been applied before purchasing. If you have any concerns about your coupon code please contact us BEFORE you place your order as we cannot apply discounts retroactively once the item has shipped. Codes must be used at the time of purchase.

HORNBLASTERS WARRANTY POLICY

THE HORNBLASTERS PROMISE

At HornBlasters we take pride in the world-class quality of our products and back that up with our promise to provide top notch customer service and technical support at all times. It is in that spirit that HornBlasters warrants to the original retail purchaser that HornBlasters products, when installed according to provided instructions and under normal use, are free from defects in material and craftsmanship for a minimum of one year from the date of purchase unless otherwise stated or covered by a HornBlasters extended warranty. LIMITED WARRANTY

HORNBLASTERS, INC. WARRANTS ITS PRODUCTS (COLLECTIVELY, THE “PRODUCTS”) AGAINST DEFECTS IN MANUFACTURING, MATERIAL, OR WORKMANSHIP UNDER NORMAL USE AND SERVICE FOR THEIR APPLICABLE WARRANTY PERIODS, SUBJECT TO CONDITIONS CONTAINED IN THIS LIMITED WARRANTY. HORNBLASTERS DOES NOT WARRANT, AND IS NOT RESPONSIBLE FOR, ANY HORNS, COMPONENTS OR OTHER DEVICE MADE BY ANYONE OTHER THAN HORNBLASTERS. THIS LIMITED WARRANTY WILL APPLY ONLY TO PRODUCTS PURCHASED FROM HORNBLASTERS OR A HORNBLASTERS-AUTHORIZED DEALER THAT IS SUBJECT TO AND FOLLOWS HORNBLASTERS’ QUALITY CONTROLS, UNLESS OTHERWISE PROHIBITED BY LAW. THIS WARRANTY IS NON-TRANSFERABLE.

IN ADDITION TO AND WITHOUT LIMITING THE GENERALITY OF THE FOREGOING DISCLAIMERS, THIS LIMITED WARRANTY DOES NOT, UNDER ANY CIRCUMSTANCES, COVER DEFECTS REULTING FROM: COSMETIC DAMAGE, INCLUDING BUT NOT LIMITED TO SCRATCHES, DENTS AND BROKEN PLASTIC UNLESS FAILURE HAS OCCURRED DUE TO A DEFECT IN MANUFACTURING, MATERIALS OR WORKMANSHIP; IMPROPER OR UNREASONABLE USE OR MAINTENANCE; FAILURE TO FOLLOW OPERATING INSTRUCTIONS, ACCIDENT; SUBMERSION; INSECTS; DAMAGE CAUSED BY ACCIDENT, ABUSE, MISUSE, FIRE, LIGHTNING, EARTHQUAKE OR OTHER EXTERNAL CAUSE; POWER SURGES; CONNECTIONS TO IMPROPER VOLTAGE SUPPLY; UNAUTHORIZED ALTERATION OR MODIFICATION OF ORIGINAL CONDITION; DAMAGES CAUSED BY INADEQUATE PACKING OR SHIPPING PROCEDURES; DAMAGES CAUSED BY USE WITH NON-HORNBLASTERS PRODUCTS; PRODUCTS THAT REQUIRE MODIFICATION OR ADAPTATION TO ENABLE THEM TO OPERATE IN ANY COUNTRY OTHER THAN THE COUNTRY FOR WHICH THEY WERE DESIGNED, MANUFACTURED, APPROVED AND/OR AUTHORIZED, OR REPAIR OF PRODUCTS DAMAGED BY THESE MODIFICATIONS; AND PRODUCTS PURCHASED FROM UNAUTHORIZED DEALERS THAT ARE NOT SUBJECT TO HORNBLASTERS’S QUALITY CONTROLS.

FOR CUSTOMERS WHO ARE COVERED BY AN APPLICABLE CONSUMER PROTECTION LAW OR REGULATION IN THEIR STATE, PROVINCE, OR COUNTRY OF PURCHASE OR RESIDENCE, THE BENEFITS TO CUSTOMER UNDER THIS LIMITED WARRANTY ARE IN ADDITION TO OTHER RIGHTS AND REMEDIES OF CUSTOMER UNDER SUCH LAWS OR REGULATIONS. SUCH BENEFITS MAY INCLUDE ADDITIONAL WARRANTIES OR RIGHTS RELATING TO THE PERFORMANCE OF THE PRODUCT AND REMEDIES APPLICABLE IN THE EVENT OF A DEFECT. THIS LIMITED WARRANTY WILL BE INTERPRETED UNDER THE LAWS OR REGULATIONS THAT APPLY TO CUSTOMER IN ANY STATE, PROVINCE, OR COUNTRY, AND ANY PROVISION OF THIS LIMITED WARRANTY. ‘RIGHTS” OR BENEFITS IS NOT APPLICABLE TO CUSTOMERS COVERED BY SUCH LAW OR REGULATION, SO THE EXCLUSIONS AND LIMITATIONS SET OUT IN THIS LIMITED WARRANTY MAY NOT APPLY, OR MAY NOT FULLY APPLY, TO CUSTOMER.

LIMITATION OF LIABILITY

IN NO EVENT, UNDER ANY CAUSE OF ACTION OR THEORY OF LIABILITY, WILL HORNBLASTERS, ITS DISTRIBUTORS, OR SUPPLIERS BE LIABLE TO CUSTOMER OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES, OF ANY NATURE WHATSOEVER, ARISING OUT OF THE USE OF OR INABILITY TO USE ANY PRODUCT, INCLUDING, WITHOUT LIMITATION, PROPERTY DAMAGE, LOSS OF VALUE OF THE PRODUCT OR ANY THIRD PARTY PRODUCTS THAT ARE USED IN OR WITH THE PRODUCT, OR LOSS OF USE OF THE PRODUCT OR ANY THIRD PARTY PRODUCTS THAT ARE USED IN OR WITH THE PRODUCT, EVEN IF HORNBLASTERS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. WITHOUT LIMITING THE FOREGOING, CUSTOMER UNDERSTANDS AND AGREES THAT HORNBLASTERS HAS NO LIABILITY FOR ANY DAMAGE OR DESTRUCTION TO CUSTOMER PERSONAL PROPERTY THAT IS CONTAINED INSIDE OR OUTSIDE PRODUCTS, INCLUDING, WITHOUT LIMITATION, LAPTOPS, SMARTPHONES, CELLULAR PHONES, OR OTHER HANDHELD DEVICES, OR ANY LOSS OF DATA CONTAINED IN THE FOREGOING DEVICES, VEHICLE PARTS, OR ANY THIRD PARTY DAMAGE. NOTWITHSTANDING ANY DAMAGES THAT CUSTOMER MIGHT INCUR FOR ANY REASON WHATSOEVER (INCLUDING, WITHOUT LIMITATION, ALL DAMAGES REFERENCED HEREIN AND ALL DIRECT OR GENERAL DAMAGES IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE), THE ENTIRE AGGREGATE LIABILITY OF HORNBLASTERS AND ANY OF ITS DISTRIBUTORS AND/OR SUPPLIERS WILL BE LIMITED TO THE AMOUNT ACTUALLY PAID BY CUSTOMER FOR ANY PRODUCT GIVING RISE TO LIABILITY. SOME STATES, PROVINCES, COUNTRIES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO CUSTOMER. THE LIMITATIONS OF LIABILITY SET FORTH ABOVE WILL APPLY TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW.

WARRANTY CLAIM PROCESS

TO SUBMIT A WARRANTY CLAIM, EMAIL HELP@HORNBLASTERS.COM OR CALL 1-877-209-8179. ANY WARRANTY CLAIMS MUST BE MADE WITHIN THE APPLICABLE WARRANTY PERIOD. WE MAY ASK YOU TO SEND US A PHOTOGRAPH OF YOUR PRODUCT TO VALIDATE THE CLAIM AND, IN SOME CASES, WE MAY ASK THAT YOU RETURN THE PRODUCT TO HORNBLASTERS FOR INSPECTION. HORNBLASTERS RESERVES THE RIGHT TO CHARGE A SHIPPING AND HANDLING FEE IN CONNECTION WITH THE EVALUATION AND FULFILLMENT OF ANY WARRANTY CLAIM.

HORNBLASTERS GIFT CARD POLICY

HornBlasters gift cards are a convenient and flexible way to purchase our products. Please note that all gift cards issued by HornBlasters expire 2 years from the date of purchase. After this period, any remaining balance on the card will be forfeited. Gift cards are non-refundable and cannot be exchanged for cash. They can be used to purchase any items available on our website. Treat your gift card like cash, as lost or stolen cards cannot be replaced. Make sure to use your gift card within the 2-year period to take full advantage of its value.

  • If you are a Customer, when you conduct transactions through our website, we will receive your transaction information. The information that we collect will include payment method information (such as credit or debit card number, or bank account information), purchase amount, date of purchase, and payment method. Different payment methods may require the collection of different categories of information.

HornBlasters relies upon a number of legal grounds to ensure that our use of your Personal Data is compliant with applicable law. Marketing Communication

When an email address is requested, HornBlaster may also ask if the customer would like to receive emails in regards to promotions or events. These emails are entirely optional and you may opt-out via the unsubscribe link included in such emails or send your request to sales@hornblasters.com. We will try to comply with your request(s) as soon as reasonably practicable. Please note that if you opt-out of receiving marketing-related emails from us, we may still send you important administrative messages that are required to provide you with excellent customer services.

HOW WE DISCLOSE DATA:

HornBlasters does not sell or rent Personal Data to marketers or unaffiliated third parties.

We share your Personal Data with trusted entities, as outlined below:

  • Service providers. We share Personal Data with a limited number of our service providers. We have service providers that provide services on our behalf, such as identity verification services, website hosting, data analysis, information technology and related infrastructure, customer service, email delivery, and auditing services. These service providers may need to access Personal Data to perform their services. We authorize such service providers to use or disclose the Personal Data only as necessary to perform services on our behalf or comply with legal requirements. We require such service providers to contractually commit to protecting the security and confidentiality of Personal Data they process on our behalf.

  • The right to request confirmation of whether HornBlasters processes Personal Data relating to you, and if so, to request a copy of that Personal Data.
  • The right to request that HornBlasters rectifies or updates your Personal Data that is inaccurate, incomplete or outdated.
  • The right to request that HornBlasters erase your Personal Data in certain circumstances provided by law.
  • The right to request that HornBlasters restrict the use of your Personal Data in certain circumstances, such as while HornBlasters considers another request that you have submitted (including a request that HornBlasters make an update to your Personal Data); and
  • Where the processing of your Personal Data is based on your previously given consent, you have the right to withdraw your consent at any time. You may also have the right to object to the processing of your Personal Data on grounds relating to your particular situation.

In order to exercise your data protection rights, you may contact HornBlasters as described in the Contact Us section. We take each request seriously. We will comply with your request to the extent required by applicable law. We will not be able to respond to a request if we no longer hold your Personal Data. If you feel that you have not received a satisfactory response from us, you may consult with the data protection authority in your country.

For your protection, we may need to verify your identity before responding to your request, such as verifying that the email address from which you send the request matches your email address that we have on file. If we no longer need to process Personal Data about you to provide our services, we will not maintain, acquire or process additional information to identify you to respond to your request.

GENERAL TERMS AND CONDITIONS

Payment Terms:

An order is not binding upon HornBlasters until it is accepted; HornBlasters must receive payment before it will accept an order. Payment for product(s) ordered is due prior to shipment. The customer can make payment by credit card, or some other method prearranged with HornBlasters. You agree to pay the amount(s) due as specified on the invoice, and you agree to pay interest on all past-due sums at a rate of 1.5% per month or the highest rate allowed by law, whichever is greater.

Use of Product:

You agree to use any products purchased from HornBlasters safely and legally. You agree to abide by all safety precautions outlined on this page, on any printed materials related to the product, and in its documentation. You also agree to obey local, state, and federal laws relating to the use of our products.

Restrictions on the Sale of Specific Products:

When placing an order with HornBlasters for a restricted item, you are stating that you are authorized to make such a purchase and that you are in compliance with all local, state, and federal laws concerning the purchase and/or use of that product.

Governing Law and Jurisdiction:

Any dispute arising out of or related to these Terms and Conditions or the sales transaction between HornBlasters and Customer shall be governed by the laws of the State of Florida, without regard to its conflicts of law rules. Specifically, the validity, interpretation, and performance of this agreement shall not be governed by the United Nations Convention on the International Sale of Goods. HornBlasters and Customer consent to the exclusive jurisdiction and the exclusive venue of the State Courts of the State of Florida, Pasco County, to resolve any dispute between them related hereto, and the parties waive all rights to contest this exclusive jurisdiction and venue of such courts. Finally, the Customer also agrees not to bring any legal action, based upon any legal theory including contract, tort, equity or otherwise, against HornBlasters that is more than one year after the date of the applicable invoice.

Severability:

If any provision contained in this agreement is or becomes invalid, illegal, or unenforceable in whole or in part, such invalidity, illegality, or unenforceability shall not affect the remaining provisions and portions of this agreement, and the invalid, illegal, or unenforceable provision shall be deemed modified so as to have the most similar result that is valid and enforceable under applicable Florida law.

Waiver:

The failure of either party to require performance by the other party of any provision of this agreement shall not affect in any way the first party’s right to require such performance at any time thereafter. Any waiver by either party of a breach of any provision in this agreement shall not be taken or held by the other party to be a continuing waiver of that provision unless such waiver is made in writing.

Entire Agreement:

These terms and conditions, together with HornBlasters.com’s invoice regarding the products ordered by Customer, are the complete and exclusive agreement between HornBlasters.com and Customer, and they supersede all prior or contemporaneous proposals, oral or written, understandings, representations, conditions, warranties, and all other communications between HornBlasters.com and Customer relating to the subject products. This agreement may not be explained or supplemented by any prior course of dealings or trade by custom or usage.

Product Listings:

HornBlasters strives for accuracy in all item descriptions, photographs, compatibility references, detailed specifications, pricing, links and any other product-related information contained herein or referenced on our website.
