As-Is, Open Box & Scratch N Dent items
All products sold “As-Is,” “With All Faults,” “Open Box,” or “Scratch N Dent” pass through any manufacturer warranty to the customer. Recourse is only under those manufacturer warranties. HornBlasters makes no representation or express warranty concerning those products except as stated in this document, and disclaims all other warranties—express or implied—including merchantability, fitness for a particular purpose, and warranties arising from statute, trade usage, course of dealing, or course of performance. The entire risk as to quality and performance is with the buyer. If an item is defective or functions improperly after purchase, the buyer—not the manufacturer, distributor, or HornBlasters—assumes the cost of servicing or repair.
Limitation of liability
In all circumstances, HornBlasters’ maximum liability is limited to the purchase price of the products sold. HornBlasters shall not, under any circumstances, be liable upon a claim or action in contract, tort, indemnity or contribution, or other claims relating to the products it sells which exceeds this liability limit. HornBlasters shall not be liable for third-party claims for damages against the customer, or for malfunction, delays, interruption of service, loss of business, loss or damage to exemplary damages, whether or not HornBlasters has been made aware of the possibility of such claims or damages.
Who is covered (applicable parties)
Only the original owner of a product purchased from HornBlasters, Inc. is covered by this limited warranty. The warranty period begins upon receipt of the product and ends when the warranty period described ends. The warranty is non-transferable and does not apply to any subsequent owner.
